These Terms & Conditions (“Terms”) govern your use of our website and your purchase of products from MEGA FINANCE LIMITED (“we”, “us”, “our”).

Our online store offers watches, jewellery, accessories and related products.

By accessing our website, placing an order or purchasing products from us, you agree to these Terms. Please read them carefully before placing an order.

Nothing in these Terms affects your statutory rights as a consumer under applicable UK law.

2. OUR ONLINE STORE

Our store may be hosted on Shopify, which provides the ecommerce platform that enables us to offer and sell our products online.

Your use of our website may also be subject to technical services provided by Shopify and other third-party providers.

3. ELIGIBILITY TO PURCHASE

By placing an order, you confirm that:

  • The information you provide is accurate and complete;

  • You are legally capable of entering into a binding contract; and

  • You are authorised to use the payment method provided.

You must not use our website or products for any unlawful or fraudulent purpose.

4. PRODUCTS

We sell products including watches, jewellery and related accessories.

We make reasonable efforts to ensure that product descriptions, specifications, materials, measurements, photographs and other information displayed on our website are accurate.

However, product images are for illustrative purposes. Colours and appearance may vary slightly depending on lighting, photography, screen settings and the natural characteristics of materials.

Where products contain natural materials, gemstones, stones, pearls, leather or similar materials, reasonable variations in colour, texture, pattern, size or appearance may occur.

Such natural variations do not necessarily constitute a defect.

5. WATCHES

Product descriptions for watches may include information regarding features, movement, materials, dimensions, water resistance and other specifications.

Customers should follow any care and usage instructions supplied with the watch.

Unless specifically described as suitable for a particular activity, customers should not assume that a watch is suitable for swimming, diving, high temperatures or prolonged exposure to water.

Water resistance may also be affected over time by wear, damage, servicing or deterioration of seals.

6. JEWELLERY

Jewellery may be manufactured from or contain different metals, stones, coatings, plating or other materials.

The relevant product description should be reviewed before purchase.

Plated, coated and certain jewellery finishes may naturally wear or change appearance over time depending on frequency of use, contact with water, perfumes, cosmetics, chemicals, cleaning products and other environmental factors.

Customers should follow any care instructions provided with the product.

7. SIZING AND MEASUREMENTS

Where applicable, product dimensions, watch case measurements, bracelet sizes, chain lengths, ring sizes or other measurements will be provided in the product description.

Customers are responsible for checking the appropriate size before ordering.

Measurements may be approximate and minor manufacturing tolerances may occur.

This does not affect your statutory rights where a product does not conform to its description.

8. PRODUCT AVAILABILITY

All products are subject to availability.

Adding an item to your shopping basket does not reserve that item.

In rare circumstances, a product may become unavailable after an order has been submitted.

If we cannot supply an ordered product, we will notify you and provide an appropriate refund for any amount already paid for that unavailable product.

9. PRICES

Product prices are displayed on our website.

We take reasonable care to ensure that prices are correct. However, errors may occasionally occur.

If we discover an obvious pricing error before accepting or dispatching an order, we may contact you to provide the correct information and give you the opportunity to continue or cancel the order.

Any applicable delivery charges will normally be displayed separately during checkout.

Where VAT is applicable, prices will be presented in accordance with applicable legal requirements.

10. ORDERS

When you submit an order, you are making an offer to purchase the products in your basket.

After placing an order, you may receive an automated order acknowledgement. An acknowledgement does not necessarily mean that we have accepted your order.

A binding contract is formed when we accept your order, which may occur when we send confirmation of acceptance or dispatch the products, depending on our checkout and fulfilment process.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • A product is unavailable;

  • Payment cannot be authorised;

  • We reasonably suspect fraud or unauthorised activity;

  • There is an obvious pricing or product-description error;

  • Delivery cannot reasonably be made to the address provided; or

  • We are legally prohibited from completing the transaction.

If we cancel an order after taking payment, we will refund the relevant amount.

11. PAYMENT

Payment must be made using one of the payment methods offered during checkout.

Depending on our store configuration, payment methods may include debit cards, credit cards, digital wallets, finance providers or other payment services.

Payments may be processed by third-party payment providers.

We do not guarantee that every payment method will be available for every transaction.

12. FINANCE PURCHASES

Where a finance or credit option is offered, that service may be provided by an independent finance provider.

Approval for finance is subject to the finance provider's eligibility requirements, affordability or credit assessments, terms and conditions and applicable regulatory requirements.

Submitting an order does not guarantee approval for finance.

Where finance is provided by a third party, the customer's credit or finance agreement may be a separate agreement between the customer and that provider.

Any cancellation or refund involving a finance purchase may need to be processed through the relevant finance provider.

13. DELIVERY

We will deliver products to the delivery address provided during checkout.

Estimated delivery dates and times are estimates unless expressly stated otherwise.

Customers are responsible for providing accurate and complete delivery information.

Our detailed delivery terms are set out in our Shipping & Delivery Policy, which should be read alongside these Terms.

Nothing in these Terms limits your statutory rights relating to delivery.

14. RISK AND OWNERSHIP

Risk in the products will generally pass to you when the products come into your physical possession or the possession of a person identified by you to receive them, subject to applicable consumer law.

Ownership of products will pass in accordance with applicable law and once we have received full payment, where applicable.

15. CANCELLATION RIGHTS FOR ONLINE ORDERS

Consumers purchasing online will generally have a legal right to cancel eligible orders within 14 days after receiving the goods, subject to statutory exceptions.

If you exercise a valid right to cancel, you must return the goods in accordance with applicable law and our Refund & Return Policy.

Certain products may be excluded from cancellation rights where a statutory exception applies, including certain personalised or custom-made products.

Nothing in this section limits your statutory rights concerning faulty, damaged, misdescribed or non-conforming products.

16. RETURNS AND REFUNDS

Returns, exchanges and refunds are governed by our Refund & Return Policy and applicable UK consumer law.

Where a customer handles a product beyond what is reasonably necessary to establish its nature, characteristics and functioning, we may be entitled to make an appropriate deduction from the refund for any reduction in value, where permitted by law.

Customers should take particular care with watches and jewellery to avoid scratching, damaging, altering or unnecessarily wearing products they may wish to return.

This does not affect statutory rights relating to faulty or non-conforming goods.

17. PERSONALISED, ENGRAVED OR CUSTOM-MADE PRODUCTS

Products made to a customer's specifications or clearly personalised, including certain engraved, specially sized or custom-made jewellery, may not qualify for the standard statutory cancellation right where the applicable legal exemption applies.

Please carefully check all spelling, sizing, engraving and personalisation information before submitting your order.

This exclusion does not affect your statutory rights where the product is faulty, not as described or otherwise does not conform to the contract.

18. FAULTY OR DAMAGED PRODUCTS

Under the Consumer Rights Act 2015, products supplied to consumers must meet applicable legal requirements, including being of satisfactory quality, fit for purpose where relevant and as described.

If you receive a faulty, damaged, incorrect or misdescribed product, please contact us promptly.

Depending on the circumstances and applicable law, you may be entitled to a repair, replacement, price reduction or refund.

Nothing in these Terms limits these statutory rights.

19. WARRANTIES AND MANUFACTURER WARRANTIES

Certain watches or jewellery products may include a manufacturer or supplier warranty.

Where a specific warranty applies, its duration and coverage may be stated on the product page or in documentation supplied with the product.

Manufacturer warranties may have exclusions, such as accidental damage, misuse, unauthorised repairs or normal wear and tear.

Any manufacturer's or retailer's warranty is provided in addition to, and does not replace or reduce, your statutory consumer rights.

20. PRODUCT CARE AND NORMAL WEAR

Watches and jewellery require appropriate care.

Normal wear and tear can include minor scratches, deterioration of plating or coatings, battery depletion, strap wear and changes caused by ordinary use.

Damage resulting from accidents, misuse, inappropriate storage, exposure to unsuitable chemicals or unauthorised modification may not constitute a manufacturing defect.

Nothing in this section excludes your rights where a product fails to meet legal requirements.

21. AUTHENTICITY AND PRODUCT INFORMATION

We are responsible for ensuring that products are described accurately as required by law.

Where a product is described as being manufactured by a particular brand, containing a particular precious metal or gemstone, or having a particular characteristic, that description forms part of the product information provided to you.

Any authenticity documentation, certificates, warranty cards, serial-number information or branded packaging supplied with a product should be retained by the customer.

22. PROMOTIONS AND DISCOUNT CODES

From time to time, we may offer promotions, discounts or promotional codes.

Promotions may be subject to separate terms, expiry dates, minimum purchase amounts, product exclusions or other reasonable restrictions disclosed with the promotion.

Unless otherwise stated, promotional codes cannot be exchanged for cash.

We reserve the right to reject the fraudulent or unauthorised use of promotional codes.

23. GIFT CARDS

If we offer gift cards, additional terms may apply.

Gift cards cannot normally be exchanged for cash except where required by law.

Expiry dates and other restrictions, if applicable, will be disclosed when the gift card is purchased.

24. WEBSITE CONTENT

All text, photographs, graphics, logos, designs and other content on our website may be protected by intellectual property rights belonging to us or our licensors.

You may use our website for personal and lawful purposes.

You must not reproduce, commercially exploit, distribute or misuse protected website content without appropriate permission.

25. REVIEWS AND USER CONTENT

If you submit a product review, photograph, comment or other content to us, you confirm that you have the right to provide that content.

You must not submit unlawful, defamatory, fraudulent, abusive, infringing or misleading content.

29. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or restricted.

If you are purchasing as a consumer, nothing in these Terms limits your statutory consumer rights.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed, subject to applicable law.

30. EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for delays or failures caused by events outside our reasonable control where permitted by law.

Such events may include severe weather, transport disruption, courier disruption, telecommunications failures, industrial action, natural disasters, government restrictions or other circumstances beyond our reasonable control.

This provision does not affect any statutory rights that cannot legally be excluded.

The Terms applicable to your purchase will generally be those in force when your order is placed.

The latest version will be published on our website with the date of the most recent update.

32. SEVERABILITY
